LITTLE ROCK, Ark. (AP) - The Arkansas Supreme Court says the mother of slain Little Rock TV anchor Anne Pressly can proceed in part with a lawsuit against a hospital and three workers who illegally looked at her daughter's medical files.
Justices ruled Thursday that Patricia Cannady can sue St. Vincent Infirmary Medical Center for outrageous behavior. But they upheld a lower court's ruling that Pressly's family cannot seek punitive damages for invasion of privacy.
A Pulaski County judge ruled last year that the law doesn't allow privacy claims after the death of the individual affected. Attorneys for the hospital and a doctor argued that rulings and law going back to the 1800s back up the judge's decision to dismiss the case.
Curtis Vance was convicted of capital murder in Pressly's 2008 death. Pressly was born and raised in South Carolina.
