Family of Woman Killed in Train Accident Files Lawsuit

Orangeburg, SC (WLTX) - The family of an Orangeburg woman killed in a train accident has filed a lawsuit in the death.

Susan Weatherford, 82, died in May of last year.

Her grandson was driving and says they swerved to miss another car when their car became stuck on the rail road tracks near Highway 601 and Sellers Avenue.

He got out, but Weatherford was unable to.

Now her estate is suing Norlk Southern Railway Company and the South Carolina Department of Transportation (SCDOT) claiming they knew there were dangerous conditions at the crossing but failed to fix them.

The suit says the SCDOT has a duty to provide safe roads and was negligent for failing to warn of hazardous conditions at the crossing.
