Brett Parker testifies on May 24, 2013.
Columbia, SC (WLTX) - Three men convicted last week on federal gambling charges are asking for a new trial.
A jury convicted Brett Parker, his father Jack, and Douglas E. Taylor last Wednesday on charges they ran an illegal gambling ring in the Midlands. Previous Coverage: Brett Parker, Two Others Convicted of Gambling
The three are arguing that they need a trial because one of the witnesses who testified against them is himself under investigation by the Security Exchange Commission. Ben Sydney Staples says he managed finances for Brett Parker's wife Tammy. Lawyers for the Parkers and Taylor argue that prosecutors knew Staples was under federal investigation when they called him to testify, and argue that the defense would have treated the witness differently if they had known that information.
Federal prosecutors have two weeks to respond to the motion.
