Accidentally Released Accused Sex Offender Now Arrested

Newberry County, SC (WLTX) -- Newberry County deputies Tuesday arrested the 25-year-old man accused of sexually assaulting a child, after the man was accidentally released from custody after a wrongly issued bond.

Deputies with the Newberry County Sheriff's Office arrested John Thurston Ussery Jr. of Irmo sometime Tuesday morning.

Thurston was originally arrested on Nov. 14 and charged with criminal sexual conduct with a minor in the first degree. Investigators say Ussery sexually assaulted an eight-year-old that he was babysitting. Previous Coverage: Accused Child Molester Accidentally Released from Jail

Ussery was released by Magistrate Judge Tom Abraham on a personal appearance bond on Nov. 15, just a day after the suspect was arrested. According to state law, when a person is charged with first degree criminal sexual conduct with a victim younger than the age of 11, the suspect's bond must be set by a circuit court judge.

Ussery is being detained at the Newberry County jail.

Authorities say that the Solicitor's Office told the Newberry Sheriff's Office to serve Ussery with a summons to appear in general sessions court on November 30. When Ussery appears in court, that's when the Solicitor's Office will ask the Circuit Court Judge to overrule the improper bond and set a new bond for Ussery.
