DAYTONA BEACH, Fla. (CBS/AP) -Ebony Wilkerson, the pregnant woman who deputies say drove her three children into the ocean at Daytona Beach was back before a judge Monday. She attended a hearing involving the custody of her kids.
Wilkerson, 32, is from Cross, SC. She is charged with three counts of attempted murder and child abuse. Witnesses on the beach were able to get her children, ages 3,9, and 10, out of the van. None of the three suffered serious injuries. A Volusia County, Florida judge set bond at $1.2 million Saturday.
Wilkerson's public defender, James Purdy, said a judge will decide if her children will stay in state custody, be placed in foster care, or go to stay with relatives.
Investigators also released a new police report on the case Monday. It says the first thing Wilkerson said after driving the minivan into the ocean was that she was abused by her husband.
The report says a Daytona Beach safety officer asked Wilkerson if she was injured after she swerved the car into the ocean last week. Wilkerson responded with the abuse allegation.
One of the children told another officer that their mother was "sleepwalking."
