COLUMBIA, S.C. (AP) - A lawsuit says South Carolina's social services agency failed to protect a 6-year-old girl from a foster child with known behavioral issues.

According to a lawsuit filed against the Department of Social Services, a boy was removed from his mother's home in 2012 and placed in foster care in Richland County. The lawsuit says DSS knew the boy had severe problems, had been sexually abused and was HIV-positive.

The lawsuit says the 14-year-old boy sexually assaulted the girl while in foster care. Attorneys for the girl say DSS failed to ensure a child with behavioral issues got appropriate monitoring and also didn't immediately tell the girl's mother the boy was HIV-positive.

An agency spokeswoman said DSS investigated the situation and disallowed the foster parent involved from having future foster children.
