Columbia, SC (AP) - South Carolina's top prosecutor is applauding a federal judge's ruling that President Barack Obama's Affordable Care Act is unconstitutional.

Attorney General Alan Wilson tells The Associated Press that he has always believed the health care overhaul to be flawed. He says the legal challenge wasn't about the guarantee of health coverage but rather the need for Congress to grant such protections lawfully.

Wilson was among 20 attorneys general who sued over the health care act dubbed by critics as "Obamacare."

On Friday, Texas U.S. District Judge Reed O'Connor ruled that last year's tax overhaul knocked the constitutional foundation from under the program. O'Connor noted that the Supreme Court had ruled the law was constitutional only as an exercise of Congress' power to tax, but last year's bill eliminated that tax.
